TERMS AND CONDITIONS
FOR YAMAHA R-N RECEIVER CASHBACK PROMOTION
ARTICLE 1 – DEFINITIONS AND INTERPRETATIONS
"Authorizd Dealer" A dealer officially authorized by the Promoter.
"Cashback Reward" The cash back available to Participants who have purchased a Promotion Product in accordance with these terms, as set out in Schedule 1.
"Claim" The process set out in Article 5.2.
"Executing Agency" BENAMIC Unlimited company

"Non-authorized Dealer" A dealer not authorized by the Promoter to sell its products that can benefit from this Promotion.
"Participant" The requirements of an individual to participate in this Promotion set out in Article 3.1.
"Promoter" Yamaha Music Europe GmbH, Siemensstraße 22-34 in 25462 Rellingen, Germany.
"Promotion" YAMAHA R-N RECEIVER CASHBACK
"Promotion Product(s)" The products set out in Schedule 1.
"Promotion Period" The period of time between the Promotion Start Date and Promotion End Date in which the Promotion Product must be purchased, as set out in Schedule 2.
"Promotion End Date" The end of the Promotion Period as set out in Schedule 2.
"Promotion Start Date The start of the Promotion Period as set out in Schedule 2.
"Proof of Purchase" The receipt requirements as set out in Article 5.4.
"Standard Currency" Euros (€).
"Terms" The Terms and Conditions as specified in this document and amended from time to time.
"Territory" The European Economic Area, United Kingdom and Switzerland
ARTICLE 2 - THE PROMOTER AND THESE TERMS
2.1. The Promoter reserves the right to cancel, amend, modify unilaterally or withdraw this Promotion at any time in its own sole discretion without any liability.
2.2. By participating in this Promotion, Participants agree that they have read, understood, accepted and will comply with these Terms.
ARTICLE 3 – ELIGIBILITY
3.1. In order to be a Participant in this Promotion you must be a resident within the Territory, aged 18 or over and have purchased a Promotion Product in accordance with these Terms.
3.2. Participants are not eligible for the Promotion if they are listed below or if they are employees, or family members of employees of:
- the Promoter;
- the Promoter’s subsidiary companies;
- the Authorized Dealers;
- any agent of those listed in Article 3.2.1-3.2.3; and
- any other parties directly involved with this Promotion.
3.3. The Promotion is only open to Participants that have purchased a Promotion Product during the Promotion Period, in accordance with these Terms.
3.4. The Promoter reserves the right to verify the eligibility of Participants and/or to exclude Participants at its sole discretion at any time for any reason. Resellers and Authorized Dealers may not submit Claims on behalf of their customers.
ARTICLE 4 – HOW TO PARTICIPATE
4.1. The Promoter is offering a Promotion whereby Participants will be eligible to claim the corresponding Cashback Reward shown in Schedule 1 when they purchase a Promotion Product set out in Schedule 1, from an Authorized Dealer, subject to full compliance with these Terms.
4.2. The Promotion is not available on any second hand, refurbished, reconditioned stock or for the products purchased from a Non-authorized Dealer.
4.3. The Participant must purchase the Promotion Product online or instore from an Authorized Dealer located in Austria, Belgium, Germany, Denmark, Finland, France Métropolitaine, United Kingdom, Ireland, Italy, Luxembourg, Netherland, Norway, Sweden to participate in this Promotion
4.4. The purchase of the Promotion Product must take place during the Promotion Period as set out in Schedule 2. The Claim for the Cashback Reward must take place by the last day to apply for the Promotion corresponding to the applicable Promotion Product, as set out in Schedule 2.
ARTICLE 5 - CLAIMS
5.1. A maximum of one (1) Claim can be claimed per participant’s Promotion Product.
5.2 After purchasing a Promotion Product from an Authorized Dealer during the Promotion Period, Participants must correctly complete the claim form available at the Landing Page in order to participate in the Promotion. Participants will be asked to provide the full name of the Participant, bank details of the Participant, if applicable, the address of the Authorized Dealer, the Proof of Purchase and the serial number of the Promotion Product. Fully completed and correct claim forms, together with a Proof of Purchase of the Promotion Products must be received no later than on last day to apply for the Promotion for each Promotion Product listed in Schedule 2 (together the "Claim").
5.3 Each Claim is limited to a single use and cannot be used in conjunction with any other promotional offer against the Promotion Products stated in Schedule 1.
5.4 Proof of purchase of the Promotion Product is required for the Claim. A Proof of Purchase is a legible copy of the original retail receipt or invoice receipt of the Promotion Product purchase, clearly showing the retailer’s name, date of purchase, product name and purchase price.
5.5 In the event that the Participant returns or exchanges the Promotion Product to the Authorized Dealer, the Participant will not be entitled to the Cashback Reward and any claim will be thereafter dismissed. For the avoidance of doubt this article does not prohibit in any way the Participant's right to exercise their applicable statutory or warranty rights.
5.6 Participants will be sent an email to confirm their Claim has been received by the Promoter upon entry of a valid Claim. Providing that the Claim is found to be valid in accordance with these Promotion Terms, Participants will be sent an email within 10 business days to confirm whether their Claim has been successful and validated.
5.7 It is the Participant's responsibility to contact the Promoter's customer service team by email at yamahamusic@promotion-support.com within 15 business days of a Claim being submitted if they have not received an email acknowledging their claim.
5.8 The Promoter will deliver the Cashback Reward via BACS transfer to the bank details provided on the Claim, within 35 days after the successful claim validation pursuant to Article 5.5.
5.9 Should the Cashback Reward not be provided in the Standard Currency and instead in a local equivalent currency, additional charges, such as bank charges may apply. Accordingly, if your bank charges you, such charges will be deducted by your bank from the Cashback Reward.
5.10 Where the Cashback Reward constitutes a taxable benefit, the tax liability lies with the Participant as the recipient.
ARTICLE 6 - DATA
6.1 Upon submitting the Claim, the Participant will provide personal data such as name, address, bank details etc., which is stored and processed by the Promoter and the Executing Agency for the purpose of administering this promotion.
6.2 You can object to the use of your personal data at any time by notifying Dataprotection@contact.europe.yamaha.com.
6.3 All personal information will be processed by the Promoter and/or the Executing Agency only in connection with the management of this Promotion including the provision of information to third parties designated to administer the Promotion. In as far as our third-party providers process your personal data, we will require them to adhere to the applicable data protection laws.

ARTICLE 7 - DISCLAIMER
7.1 No responsibility will be accepted for Claims lost, delayed or for those Claims not received by the last day to apply for the Promotion.
7.2 Claims will be disqualified if incomplete, illegible, or if the Participant does not satisfy Article 3. It is the Participant’s responsibility to ensure that sufficient details are provided for Claims to be processed.
7.3 The Promoter is not liable for any costs incurred by the Participant relating to the Promotion.
7.4 The Promoter shall not be liable for any delayed Claims of any nature regarding this Promotion.
7.5 The Promoter shall not be liable for any failure to fulfil this offer where such failure is caused by any supervening circumstances amounting to force majeure or third party fault (being beyond the Promoter's reasonable control) and/or events which, without the fault of either party, render performance impossible or incapable of satisfactory execution.
7.6 The Promoter, in its sole discretion, reserves the right to reject any Claim that it deems to not comply with these Terms.
7.7 The Promoter has the right to request reimbursement of the Cashback Reward for the returned, exchanged, or cancelled Promotion Product purchases.
7.8 The Cashback Reward for Promotion Products listed in Schedule 1 are fixed and not dependent on the sale prices set by Authorized Dealers, who determine their own prices independently. The Cashback Reward cannot be exchanged for products or alternative rewards.
7.9 If any provision of these Terms should be deemed invalid in whole or in part, this does not affect the validity of the remaining provisions. An ineffective provision shall be replaced by a provision which is legally permissible, and which comes closest to the provision deemed invalid, in terms of content.
ARTICLE 8 - JURISDICTION
These Terms are governed by the laws of Germany. In the event of conflict between German law and the consumer laws of the country in which the Promotion Products were purchased, the latter will take precedence. The Terms are subject to the exclusive jurisdiction of the courts of Germany.
